Frequently Asked Questions about the FfE licence

Does the mark just apply in Australia?

No, anyone can apply the mark and anyone can use FfE material subject to the conditions described.

Does the material have to be educational?

No the FfE mark can be applied to any material, this could include government information, company fact sheets, checklists, technical specifications.

Neither the AEShareNet licensing system, nor TVET Asutralia Limited determines the materials to which the FfE mark is applied, and gives no warranty of any sort regarding those materials.

How do I take out an FfE licence?

You do not need to do anything to formalise an FfE licence. The licence arises automatically if and when:

Do I have to be a member of AEShareNet to use the mark or use material under the FfE licence?

No.

How are disputes resolved?

The AEShareNet Charter provides a procedure for resolution of disputes. By affixing the mark (for the Licensor) or using material under the conditions of the licence (for the Licensee), the parties agree to abide by the provisions of the AEShareNet Charter including those relating to resolution of disputes.

Can I copy a copy of FfE material that did not come from the owner?

Yes but it would be your responsibility to ensure that the copy you obtained was legitimately made and retained any original copyright information placed on it by the owner. It is preferable to obtain a copy direct from the owner if possible, both to ensure that it is legitimate, and to ensure that you have the latest version.

What extent of material is covered by affixing the mark?

It is the responsibility of the owner to clearly identify what content the mark covers (eg part or all of a publication, part or all of a website). If you are unclear, contact the owner.

Can I use FfE material for commercial education and training?

Yes, you can use FfE in courses and training activities for which a fee is charged. However note the conditions about charging for copies of material (as opposed to charging for a course).

Can I use FfE material for non-accredited training?

Yes, provided it is for "a structured program of learning or teaching for the benefit of a learner".

Can I modify the material?

You are not entitled to make any substantive changes to the material. You may take an excerpt of the material, provided that you do not deal with the material in a way that might:

You should retain any embedded copyright information (including the FfE mark) on copies that you make, in accordance with the rules of the AEShareNet-FfE Licence Protocol.

You are permitted to make an "Edited Version" for educational purposes only. This covers changes which are of such a minor nature that no fresh layer of copyright can be said to arise. For example modifications in which names and contexts have been substituted to adapt the Material for a different learning environment.

For Edited Versions the original copyright notice, FfE mark and an appropriate disclaimer about the changes you have made should be included.

You are permitted to use the material to make a "Supplementary Work" for educational purposes only. This means substantial additional work which appends, incorporates, is appended to, or is incorporated into, the Licensed Material, but which has some capacity to inform or entertain independently of the Licensed Material. The original copyright notice and FfE mark should be retained. You should also apply your own copyright statement to the Supplementary Work.

You are permitted to include the material in a "Compilation" for educational purposes only. Compilation means a collection of items (which may or may not individually have copyright) which are selected, ordered and arranged using sufficient skill and care as to attract copyright for the collection as a whole.

Can I sell the material?

No. You are not permitted to sell the original or modified material to any third party (except learners as described above - which includes charging learners for copies of materials on a cost-recovery basis).

Can I advertise / upload my FfE materials via the AEShareNet website?

No, there is currently no provision for members of AEShareNet to describe their FfE materials in the Local System and upload details to the AEShareNet site. The FfE licence operates quite differently to AEShareNet S, C and P licences.

Can I, as owner, withdraw material from offer under the FfE protocol?

You can stop making copies available with the mark on it. However if a potential user has previously legitimately obtained a copy with the mark on it they are still able to exercise the licence.

How do FfE licences affect copyright collection agency (eg CAL) records?

(This answer is relevant to Australian users only. Part VB of the Australian Copyright Act 1968 provides a statutory licence under which educational institutions may copy and communicate material for educational purposes. Copyright Agency Limited (CAL) is the collecting society responsible for collecting revenue under the statutory licence, and distributing the revenue amongst copyright owners.)

When you use material under an FfE licence it is not necessary to comply with the conditions of the statutory licence set out in the Act. For example:

Similarly when you put the FfE mark on materials you own, you forego the right to receive remuneration under Part VB for those uses that are covered by the FfE licence.

How does FfE affect Moral Rights?

Moral Rights of the authors are unaffected by the licence. You should make your own judgements and obtain any necessary consent. You indemnify the owner against any claims for breach of Moral Rights arising from your use of the material.
